Ratification Bulletin for Kootenay Lake

On June 14, 2006 your Bargaining Committee reached an agreement on the new Collective Agreement with Western Pacific Marine.

The following is a summation of the more important changes to the Collective Agreement.

Effective April 1, 2006

 .60 cents general wage increase (except for Marine Clerk). This averages out to a 2.3% wage increase.

 Probation for Regular employees reduced from 6 months to 630 hours.

 Expedited Arbitration process, hearings done locally twice a year.

 Vacancies posted at worksite where vacancy occurs.

 Temporary vacancies filled after 4 months rather than 7 months.

 Vacancies filled by service seniority from within worksite first, then consideration given to other employees within KLFD worksites.

 Expedited appeal process for those who feel they should have been awarded a vacancy.

 Probation upon promotion reduced from 6 months to 630 hours.

 New clearer layoff and recall language for regulars which includes;

- Layoff by service seniority not classification seniority

- Pre-layoff canvass with severance and early retirement options

- Bumping by service seniority

 Laid off regulars who opt to go on to the auxiliary recall list who fail to maintain 1200 hours will be credited with combined previous auxiliary seniority hours and regular seniority converted to hours.

 Overtime banked in dollars rather than hours as has been the practice. Employees will have time off paid at base rate or substitution rate at the employees choice. Wage increases will be applied to overtime banks.

 An extra 105 hours may be carried over to the following year for the purpose of attending training courses.

 Medical exams at the request of the employer or employer's insurance carrier to be paid by employer (this is not the STO2 form).

 Terms of extended health benefits added to Collective Agreement.

 Auxiliaries have the right to remain at the bottom of the auxiliary recall list with the ability should they choose later to start building seniority.

 Auxiliary employees who work 1827 hours in less than 12 calendar months shall receive the full 77 hours in lieu of statutory holidays.

 Auxiliaries to receive letter of appointment once when hired or at the beginning of a long term substitution.

 Auxiliaries allowed to decline work once within a callout, without penalty.

 Agreement that should WPM lose the contract that all time banks will be transferred to the incoming employer.

 Part time employees have access to continuous full time employment prior to auxiliary employees.

 Agreement that should MEDS be required for cable ferries, the employer shall grant education leave with pay and benefits as per 20.7 to obtain certificate.

 Training on cable ferries shall be offered to the senior employee within the seniority block.

 On cable ferries, winter insulated coveralls supplied by the employer.

 Dual Head Cable Ferry Operator reclassified to R16.

 Marine Addendum Article 6.15 clarification of language on short term and long term substitutions.

 Marine Clerk reclassified to R 11.

 Elimination of 5 steps within grid level for regular employees. All regulars move to Step 5.

 3 step grid system for Auxiliaries.

 Auxiliaries substituting to higher classifications are paid at highest step during substitution.

 $7500.00 annual training budget.

 Article 20.11 Leave for Medical/Dental care increased to $350.00.

 Article 27.8 Vehicle allowance increased.

Vehicle allowance shall be:

Effective April 1, 2006 47¢ per km.
Effective April 1, 2007 48¢ per km.
Effective April 1, 2008 49¢ per km.

 Article 27.9 Meal allowance

 New Marine Addendum - Article 10.4 - Safety Equipment (boot allowance)

 New Article 18.4
Where an employee receives the higher rate of pay pursuant to 18.4(a), the resulting left over ETO at the end of the year equal to or less than the amount of vacation taken at the higher rate will be paid at straight time rates.

 New addition to Article 3, Marine Addendum
Pro-rated Annual ETO allotment to account for number of sick days taken.

Effective April 1, 2007
 .60 cents general wage increase This averages 2.3% wage increase.

Effective April 1, 2008
 2nd Class Engineer reclassified to R 25
 3rd Class Engineer reclassified to R22
 Osprey Mate reclassified to R 20
 Deckhand and Cable Ferry Operators reclassified to R10
 2.5% general wage increase

Effective April 1, 2009
 3.5 % general wage increase.

Collective Agreement expires March 31, 2010

Your Bargaining Committee is recommending acceptance of this agreement and have scheduled a ratification meeting for Thursday, June 22, 2006 at 7:00 p.m. at the Best Western Baker Street Inn.
